Terms of service
Draft updated September 9, 2026
These draft terms describe the proposed conditions for using Thoughtsent to send messages, flowers, gifts, gift cards, and printed cards. They are not a statement that production payments, vendor fulfillment, or all support procedures are already active.
Using Thoughtsent
Use the service only for lawful, voluntary gifts, cards, and messages. Provide accurate information and use recipient contact details only when you have a legitimate basis to contact that person. You are responsible for messages you submit and must have the right to use any supplied content.
Accounts and guest checkout
Sending may be available without an account. If you create an account, protect your credentials and do not use another person's identity. A recipient is not required to create an account merely to respond to an invitation.
Invitations and acceptance
A sender sends a gift, card, or message; the recipient may accept, decline, report a concern, or decline because of workplace rules. An invitation is not a guarantee of acceptance or delivery. The gift claim and acceptance policy describes the response process and expiration.
Prices and payments
Review the item price, currency, delivery charges, service charges, and taxes displayed before confirming payment. Stripe processes checkout payments. A card authorization is a temporary hold, not a completed charge, and may expire under the payment provider's rules.
The proposed payment model authorizes at checkout and captures after acceptance, subject to authorization validity and fulfillment availability. Capture, cancellation, and refund procedures must be completed and verified before production use. A status displayed in the application alone is not proof that a payment or refund has been processed.
Fulfillment and availability
Products, service areas, delivery dates, and inventory depend on the relevant provider. Delivery estimates are not guarantees. Recipient addresses and other required delivery details must be available before physical fulfillment. Sandbox orders do not produce real shipments or redeemable rewards.
The flower delivery policy at /flower-policy explains bouquet sizes, delivery areas, seasonal stem variations, cancellations and quality claims. A materially different bouquet requires the sender's agreement; otherwise an unavailable bouquet is cancelled and its payment released or refunded. Gift cards are subject to the issuing brand's redemption terms, regional restrictions, and applicable law. Printed items require approved artwork and accurate mailing details.
Declines, cancellations, and refunds
A declined or expired invitation should not proceed to fulfillment. Whether a payment requires an authorization release or a refund depends on its actual payment state. Timing depends on the processor and financial institution; no specific refund completion time is promised by this draft.
Once production or redemption begins, cancellation or returns may be restricted by the provider and applicable law. Final provider-specific cancellation, damaged-item, failed-delivery, and refund rules, together with a monitored support contact, must be published before live sales.
Prohibited conduct
Do not use Thoughtsent for harassment, threats, stalking, impersonation, fraud, unlawful content, repeated unwanted contact, or attempts to obtain private recipient information. Do not bypass claim controls, misuse payment instruments, or send gifts that violate workplace, professional, anti-bribery, or other applicable rules. Access may be restricted to investigate misuse or protect users.
Service limitations and legal rights
Service interruptions and third-party failures may occur. Nothing in these draft terms excludes rights or remedies that applicable law does not allow to be excluded. Governing law, the operating legal entity, dispute procedures, and any appropriate liability provisions require legal review before publication.
Contact and changes
A business address and monitored customer support contact must be added before launch. Updated final terms should identify their effective date and explain how material changes will be communicated.
